These terms govern your use of our websites, products and services. Please read them before using anything we operate.

These Terms and Conditions ("Terms") are an agreement between you and FollowCan Technologies ("FollowCan Technologies", "we", "us"), registered at Vikaspuri, Delhi, India. They apply to our websites, our products — including HashtagCMS, MsgBrd.tv, FollowCan and Social Media Manager — and any services we provide (together, the "Services").
1. Acceptance of these terms
By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services. If you are using the Services for an organisation, you confirm you are authorised to accept these Terms on its behalf.
2. Our services
We provide software products and engineering services. Individual products may carry additional terms, and where those conflict with these Terms, the product-specific terms govern for that product.
Engineering and consulting work is governed by a separate written agreement covering scope, fees, deliverables and ownership. Nothing on this website constitutes an offer to perform such work on particular terms.
3. Accounts and security
Where a Service requires an account, you agree to:
- provide accurate registration information and keep it current;
- keep your credentials confidential and not share them;
- take responsibility for activity under your account; and
- tell us promptly at [email protected] if you suspect unauthorised access.
We may suspend an account where we reasonably believe it has been compromised or is being used in breach of these Terms.
4. Acceptable use
You agree not to use the Services to:
- break any applicable law or regulation;
- infringe the intellectual property or privacy rights of others;
- send unsolicited, deceptive or unlawful messages;
- upload malware or anything designed to disrupt systems or data;
- probe, scan or test the security of the Services without our written permission;
- place unreasonable load on our infrastructure, or scrape it at scale; or
- reverse engineer our non-open-source software except where law permits.
5. Messaging, consent and third-party platforms
Social Media Manager sends messages through third-party platforms, including WhatsApp. Those platforms set their own policies on consent, message templates and commercial messaging, and those policies apply to you in addition to these Terms.
When using any messaging feature, you are responsible for ensuring that:
- every recipient has given valid consent to be contacted by you;
- you honour opt-out requests promptly and permanently;
- your content complies with the platform's policies and applicable marketing law; and
- you hold any registrations or approvals your jurisdiction requires.
We may suspend messaging features where we receive credible reports of abuse, or where a platform requires it. Third-party platforms may change, restrict or withdraw their services at any time, and we are not responsible for the consequences of them doing so.
6. Intellectual property
The Services, and all software, design, text and branding within them, are owned by FollowCan Technologies or our licensors and are protected by intellectual property law. Except for the rights expressly granted here, no licence is given.
You keep ownership of the content and data you submit to the Services. You grant us a limited licence to host, process and transmit that content strictly as needed to provide the Services to you.
7. Open-source components
Some of our software — including HashtagCMS — is released as open source, and the Services incorporate third-party open-source components. Each is licensed under its own terms, which apply to your use of that component and override these Terms to the extent of any conflict.
8. Beta and in-development products
Products marked as in development, preview or beta — FollowCan is currently one — are offered as-is for evaluation. They may be incomplete, may change substantially, may lose data, and may be withdrawn without notice. Do not rely on them for production use.
9. Fees and payment
Paid Services are billed as set out in your order or subscription. Unless stated otherwise, fees exclude taxes, are payable in advance, and are non-refundable except where law requires or we agree in writing. We may change pricing on one month's notice, effective at your next renewal.
10. Disclaimer of warranties
Except where expressly stated in a signed agreement, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any output — including output generated by AI features — will be accurate or suitable for your purposes. You are responsible for reviewing AI-generated output before relying on it.
11. Limitation of liability
To the maximum extent permitted by law, FollowCan Technologies will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, however caused.
Our total aggregate liability arising out of or relating to the Services is limited to the amount you paid us for the Service in the month preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
12. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access where you materially breach these Terms, where required by law, or where continued provision poses a security or legal risk. On termination, your right to use the Services ends immediately; sections that by their nature should survive — including intellectual property, disclaimers, liability and governing law — continue to apply.
13. Changes to these terms
We may update these Terms from time to time. We will revise the "last updated" date above and, where changes are material, give reasonable notice through the Services or by email. Continuing to use the Services after changes take effect means you accept them.
14. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict of law rules. The courts of India have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any competent court to protect its intellectual property.
If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
